Terms of Service

These Terms are an agreement between you and Outish. They cover who can use Outish, how subscriptions work, the rules for the community, and the important fact that meeting people in real life is your responsibility. By using Outish, you agree to them.

1. Acceptance of these Terms

By creating an account or using the Outish app (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the Service. The Service is provided by Outish LLC, a Michigan limited liability company ("Outish," "we," "us," or "our").

2. Eligibility — you must be 18 or older

You must be at least 18 years old to use Outish. By creating an account you self-attest that you are 18 or older and that you are legally able to enter into this agreement. Outish is rated 18+ on the Apple App Store and Google Play. Accounts found to belong to anyone under 18 will be terminated.

3. Your account

• You must register with a valid phone number and verify it via SMS before you can access content. We verify phone numbers only — we do not require identity documents or biometric data.
• You're responsible for activity on your account and for keeping access to your phone and account secure.
• You agree to provide accurate information and not to impersonate anyone or create an account on someone else's behalf.
• One account per person. Creating accounts to evade a ban or account suspension is prohibited.

4. Subscriptions, billing, and trials

Outish is a paid subscription service. There is no free tier — the subscription model keeps the community intentional and real.

• Plans. Standard pricing is $19.99 per year or $3.99 per month. Prices are in U.S. dollars and may change; we'll give notice of changes as required by law, and changes won't affect the term you've already paid for.
• Price changes for new members. We may raise the price for members who join later. If we do, the rate you subscribed at continues to apply to your subscription for as long as it stays active, in accordance with the app store's rules for existing subscribers.
• Free trial. New members may start with a 30-day free trial. If you don't cancel before the trial ends, your subscription begins and the applicable fee is charged.
• Auto-renewal. Subscriptions renew automatically at the end of each term until you cancel. You can cancel anytime; cancellation takes effect at the end of the current billing period.
• App-store billing. If you subscribe through the Apple App Store or Google Play, billing, renewals, and cancellations are handled by that store under its terms, and you manage them in your store account.
• Failed payment. If a renewal payment fails, your account enters a grace period during which you keep access while the store retries the charge. If the payment is never resolved, the account is suspended — your broadcasts are hidden rather than deleted — until you resubscribe.
• Refunds. Except where required by law or store policy, fees are non-refundable.

5. Community rules and acceptable use

Outish is for genuine, real-life connection between people who know each other. You agree not to:

• Harass, threaten, stalk, intimidate, or harm anyone.
• Post content or broadcasts that are illegal, hateful, sexually exploitative, or that promote violence or self-harm.
• Use Outish to facilitate any crime, or to meet anyone for an unlawful purpose.
• Impersonate another person or misrepresent your identity, location, or affiliation.
• Add or attempt to contact people you don't actually know, or use the Service to spam, solicit, advertise, or recruit.
• Collect or share other members' personal information without consent.
• Interfere with, reverse-engineer, scrape, or attempt to disrupt or gain unauthorized access to the Service.

You are responsible for the content you post. Broadcasts and other content you create must comply with these rules. We may remove content and take action on accounts that violate them.

6. Objectionable content — zero tolerance, and how to report it

There is no tolerance for objectionable content or abusive members on Outish. If you encounter either:

• Block. You can block any member from inside the app. Blocking removes the connection in both directions immediately and stops any further contact through the Service.
• Report. Tap the “···” menu on a member’s outing — on your home feed, on the map, or in the outing details — or on their row in your friends list, and choose Report. You can add a note about what happened, but you don’t have to. We hide that member’s outings from you right away and a person on our team reviews the report. If you can’t reach the app, you can still email [email protected] with the member’s name or handle and what happened.

We review every report and act on it within 24 hours — by removing the content, suspending the account, or terminating it permanently. Members who post objectionable content or who abuse other members are ejected from the Service.

7. Meeting people in real life — your responsibility

Outish surfaces what your mutual friends are doing so you can choose to show up. Any interaction or meeting that happens in the physical world is solely between you and the other people involved. We do not verify identity or age beyond a phone number, we do not conduct background checks, and we do not monitor in-person conduct. We cannot and do not guarantee anyone's identity, behavior, or your safety. The mutual-friends-only social graph, in-app blocking, and the reporting process in Section 6 exist to help you manage your network, but they are not a substitute for your own judgment. Meet in public when it makes sense, and take the same precautions you would in any real-world social situation.

8. Your content

You keep ownership of the content you post. You grant Outish a limited, non-exclusive license to host, store, and display your content as needed to operate the Service (for example, showing your broadcast to your mutual friends). This license ends when your content is deleted or expires, except for backups or as needed to comply with law.

9. Suspension and termination

• You may stop using Outish and delete your account at any time — see Account Deletion.
• We may suspend or terminate your account if you violate these Terms, if your payment lapses, or if we reasonably believe it's necessary to protect members or comply with law.
• Sections that by their nature should survive termination (including content license terms, disclaimers, and limitations of liability) will survive.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any member will behave lawfully or safely.

11. Limitation of liability

To the fullest extent permitted by law, Outish and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from interactions or meetings between members. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

12. Governing law

These Terms are governed by the laws of the State of Michigan and the United States, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Ingham County, Michigan, and you consent to personal jurisdiction and venue there. Nothing here prevents you from bringing a qualifying claim in small-claims court.

13. App store terms

You download Outish from, and subscribe through, the Apple App Store or Google Play, and your use of the app is also subject to that store’s own terms.

• Apple. These Terms are between you and Outish only — not Apple. Apple is not responsible for the app or its content, has no obligation to furnish maintenance or support, and is not responsible for addressing any claim you have relating to the app, including product-liability claims, any claim that the app fails to conform to a legal requirement, and claims arising under consumer-protection or privacy law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Google. These Terms are between you and Outish only — not Google. Google is not responsible for the app or its content and has no obligation to provide support for it.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
